Meta Antitrust Suit Dismissed

After class certification was denied in an antitrust suit against Meta, individual plaintiffs continued to seek trial on their claims. Plaintiffs claimed that Meta illegally acquired and maintained a monopoly in a purported personal social networking services market by deceiving users about Facebook’s data collection and privacy practices. Plaintiffs argued that, in a competitive market, Meta would be forced to pay users $5 a month for use of their personal data. 

Compass Lexecon experts Dennis Carlton, Anindya Ghose, and John List submitted testimony on the merits of plaintiffs’ antitrust claims on behalf of Meta.

On September 29, 2025, US District Judge Donato granted summary judgment, terminating the case. Judge Donato concluded that after denial of class certification, plaintiffs’ claims “fare no better a second time around.” Judge Donato excluded plaintiffs’ antitrust injury expert testimony, and found that as a result “plaintiffs face an insurmountable barrier to proving antitrust injury.”
